This Act may be cited as the Public Transit Operators Protection Act (Bregg's Law). R.S., c. C-46 CRIMINAL CODE 2. The Criminal Code is amended by adding the following after section 265: Definition of “public transit operator” 265.1 For the purposes of sections 266 to 269, “public transit operator” means the person who operates a public transit vehicle, including a bus, paratransit vehicle, school bus, highway coach, light rail train or subway train. 3. Section 266 of the Act is renumbered as subsection 266(1) and is amended by adding the following: Aggravating circumstance for sentencing purposes (2) If a person is convicted of an offence under this section, the court imposing the sentence on the person shall consider as an aggravating circumstance the fact that the victim of the offence is a public transit operator engaged in the performance of their duty at the time the offence was committed. 4. Section 267 of the Act is renumbered as subsection 267(1) and is amended by adding the following: Aggravating circumstance for sentencing purposes (2) If a person is convicted of an offence under this section, the court imposing the sentence on the person shall consider as an aggravating circumstance the fact that the victim of the offence is a public transit operator engaged in the performance of their duty at the time the offence was committed. 5. Section 268 of the Act is amended by adding the following after subsection (4): Aggravating circumstance for sentencing purposes (5) If a person is convicted of an offence under this section, the court imposing the sentence on the person shall consider as an aggravating circumstance the fact that the victim of the offence is a public transit operator engaged in the performance of their duty at the time the offence was committed. 6. Section 269 of the Act is renumbered as subsection 269(1) and is amended by adding the following: Aggravating circumstance for sentencing purposes (2) If a person is convicted of an offence under this section, the court imposing the sentence on the person shall consider as an aggravating circumstance the fact that the victim of the offence is a public transit operator engaged in the performance of their duty at the time the offence was committed.
